1. Introduction
Welcome to CollectiveInfoHaven ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at collectiveinfohaven.sbs (the "Service") provided by CollectiveInfoHaven.
By booking a charter or accessing our Service, you consent to adhere to these Terms. If you do not agree with any part of these terms, you should refrain from accessing the Service.
2. Service Overview
CollectiveInfoHaven offers high-end yacht charter services, including but not limited to:
- Day-long yacht hires
- Evening cruises
- Company getaways
- Special events
- Extended charters
Our services are available depending on vessel availability and weather conditions. We may adjust or cease services without prior notice at our discretion.
3. Booking and Reservations
3.1 Booking Process
For booking a charter, the following requirements must be met:
- Minimum age of 18 years
- Submission of truthful and complete information
- Advance payment of the specified deposit in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Confirmation of your booking occurs only after payment is made and our written acknowledgement is issued. We reserve the right to decline service to any individual at our discretion.
3.3 Availability
Charter services are contingent on the availability of the vessel and appropriate weather conditions. We will attempt to fulfill your requested dates and times to the best of our abilities.
4. Payment Terms
4.1 Pricing
All listed prices are in € and encompass all relevant taxes unless specified otherwise. Pricing is subject to change without prior notice.
4.2 Payment Schedule
- Initial Deposit: 50% of the entire cost of the charter, due upon reservation
- Final Payment: Must be made 48 hours before the charter sets sail
- Incidental Expenses (as applicable): Payable after the conclusion of the charter
4.3 Methods of Payment
We accept a variety of payment methods including major credit cards, wire transfers, and certified bank drafts. All payments are processed through secure, encrypted protocols.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours before departure: Full refund, minus processing charges
- From 24 to 72 hours prior to departure: 50% of the fee will be refunded
- With less than 24 hours until departure: Refunds will not be issued
5.2 Weather-Related Cancellations
In case our captain deems weather conditions as dangerous, options provided will include:
- Rescheduling the charter for the next possible opening without additional charges
- Issuing a full refund when rescheduling is unfeasible
5.3 Technical Difficulties
If there is a technical issue with the yacht assigned, we will endeavor to arrange an appropriate alternative. If a substitute is unavailable, we will issue a complete refund.
6. Safety and Conduct
6.1 Safety Regulations
All guests are required to:
- Adhere to all directions provided by the crew
- Utilize safety gear as necessary
- Disclose any health conditions that might impact safety
- Stay within specified areas on the vessel
6.2 Restricted Items
The following items are prohibited onboard:
- Containers made of glass
- Contraband substances
- Guns or other armaments
- Excessively large quantities of beverages
- Pets (approval required beforehand)
6.3 Passenger Behavior
Patrons should maintain a courteous and considerate demeanor at all times. Should a passenger's conduct create a safety hazard or mar the experience for others, we may end the charter in advance without a refund.
7. Liability and Insurance
7.1 Limitation of Our Responsibility
Our responsibility is limited to the amount paid for the charter. We are not accountable for:
- Injuries sustained due to passenger negligence
- Any loss or damage to personal belongings
- Indirect, accidental, or punitive damages
- Delays resulting from weather or uncontrollable scenarios
7.2 Insurance
We possess comprehensive marine insurance that covers our fleet and operations. It is the obligation of passengers to secure personal travel insurance.
7.3 Acknowledgement of Risk
By engaging with our yacht services, you recognize that maritime activities carry inherent risks. You agree to assume all responsibility for your safety and well-being.
8. Modifications and Itinerary Adjustments
Itinerary changes, such as alterations or scheduling shifts, may be made due to weather conditions, safety needs, or operational demands. Every attempt will be made to provide suitable alternative experiences.
9. Force Majeure
We cannot be held responsible for delays, cancellations, or alterations stemming from factors beyond our control, including, but not restricted to:
- Extreme weather events
- Natural calamities
- Regulatory edicts
- Port shutdowns
- Equipment failures
10. Privacy and Data Security
How we handle your personal data is outlined in our Privacy Policy. Use of our services implies agreement to the collection and utilization of your information as detailed in the Privacy Policy.
11. Intellectual Property Rights
Content on our website, including text, visual elements, trademarks, and graphics, is the subject of copyright and trademark legislations. Unauthorized reproduction, distribution, or the creation of derivative works is prohibited without our explicit consent.
